昨年、控訴裁判所は、ジェイの犯罪は軽微であると指摘しましたが、専門家はジェイが公衆に非常に高いリスクをもたらすと考えていると述べました。人権弁護士のトニー・エリスとグレーム・エドグラーが母親を代理して、彼の拘禁は彼の人権を侵害していると主張する。

控訴では、裁判所が地域社会の安全と障害者の権利のバランスを取っているかどうかについても取り上げる。人権委員会とIHCは、同法に関連する人権と障害の問題に関する議論に貢献する予定です。

ジェイが初めて拘禁されたのは2004年、隣人の窓を斧で割った後だった。彼は起訴されたが、障害があるため裁判に適さないことが判明した。2006年、彼は安全な医療施設に入れられ、それ以来ずっとそこに留まり、過去4年間はオークランドのメイソン・クリニックで完全に隔離されて過ごしました。

専門家によると、ジェイが釈放されれば「暴力のリスクが高い、または非常に高い」とのことです。治療を受けている間、彼は武器を盗もうとしたり、スタッフを脅迫したり、財産に損害を与えたりしました。支持者たちは、彼が適切なリハビリを受けておらず、常に訓練を受けたスタッフによるケアを受けているわけではないと主張している。

2021年にメイソン・クリニックを視察したところ、自閉症患者には適していない可能性があることが明らかになりました。報告書は、拘束や隔離が継続的に行われていることを批判するものの、以前からその削減が約束されていたにもかかわらず増加していたことを批判しました。
