  • 時間通りに来てください。早めに到着して待っている方が、遅刻して裁判を台無しにするよりは良いでしょう。
  • 法廷内での飲食はご遠慮ください。
  • 裁判官のために起立してください。法廷にいる人は、敬意を表すために裁判官の到着と退出の際には起立して黙っているのが習慣となっています。また、裁判官が直接あなたに話しかけている場合も起立しなければなりません。
  • ゆっくりと、はっきりとした声で話してください※。法廷での発言は、法的手続きの重要な部分を占めます。間違いを防ぐために、話す速度を遅くし、間違いがありそうな場合は恐れずに名前のスペルを言うようにしてください。
  • 悪態をつかないこと。
  • 証人が証拠を述べているときは、話をしないでください。
  • 正式な呼称を使うこと。裁判官にはSir、Ma’am、Your Honourのいずれかをつけます。それ以外の人は、「Mr」「Ms」をつけて苗字で呼ぶことができます。
  • 必要に応じて書類やコピーを持参してください。法的手続きには多くの書類が必要なので、裁判所が必要とする書類があるかどうか確認してください。必要に応じて追加のコピーを持参してください。

※ニュージーランドの裁判は、通常、英語で行われます。英語を母国語としない方で、法廷で自分の発言を伝えるために通訳が必要だと思われる方は、「通訳依頼(request for interpreter)」フォームに記入する必要があります。審理の前に、出席する裁判所にこのフォームを提出してください。

法廷での本人訴訟

裁判所に到着したら、セキュリティを通過しなければなりません。その後、どこに行けばよいかわからない場合は、裁判所のスタッフに道を尋ねることができます。法廷では、真実を話すことを誓う「宣誓」や「断言」を求められることがあります。審理終了後、スタッフは次のステップのお手伝いをしますが、法的なアドバイスはできません。法律上のアドバイスは、弁護士または市民相談所にのみ依頼してください。

法廷での代理人として弁護士を必要とせず、必要に応じて自分で代理人になることもできます。しかし、法廷で適切な弁護活動を行うには、多くの調査、準備、管理を長期間にわたって行う必要があります。ほとんどの場合、解決には数ヶ月かかりますが、中には数年かかるケースもあります。仮に勝訴して補償を受けることができたとしても、本人訴訟に費やした時間と費用は、裁判費用には含まれません。

本人訴訟を検討する前に、通常は、市民相談所や共同体法に無料の法的アドバイスを求めるのが良いでしょう。彼らはあなたが正しい方向に進む手助けをしてくれます。あなたが弁護士を立てたくても雇う金銭的な余裕がない場合は、法律扶助を受けることができます。
