사랑하는 사람을 지지하기 위해서든, 증언을 위해서든, 자신을 변호하기 위해서든, 어떤 이유로든지 법정에 출석해야 하는 일에는 큰 스트레스가 뒤따릅니다. 뉴질랜드 법정에 설 때에는 어떻게 해야하는지 미리 파악해, 막연한 불안감을 덜고 마음의 준비를 단단히 해둡니다.

 

일반 규칙
다음은 법정에 출석할 때 기억해야 할 몇 가지 일반적인 규칙입니다.

  • 뉴질랜드의 법정은 매우 공식적인 장소입니다. 넥타이한 정장과 같이 어둡고 스마트한 옷을 입어야 합니다. 모자나 선글라스는 쓰지 마세요.
  • 휴대폰을 사용하지 마세요. 법정에서는 무음으로 해두고, 사진, 동영상 촬영은 안됩니다.
  • 제시간에 도착하세요. 위태위태하기 늦는 것보다 일찍 도착해서 기다리는 게 나아요.
  • 법정에서 음식을 먹거나 마시지 마세요.
  • 판사를 향해 기립합니다. 법정에서는 존경의 표시로 판사가 들어오고 나갈 때에는 일동 기립하여 침묵하는 것이 관례입니다. 판사가 직접 판결을 내릴 경우에도 자리에서 일어납니다.
  • 천천히 또박또박 말하세요*. 법정에서의 진술은 법적 절차로써 아주 중요한 부분입니다. 실수를 피하려면 말하는 속도를 늦추고, 실수가 있다면 두려워 말고 이름을 말하세요.
  • 욕설 안돼요.
  • 증인이 증언할 때는 말하지 마세요.
  • 공식 직함을 사용하세요. 재판관을 호칭할 때는 Sir, Ma’am , Your Honour로 부르세요. 다른 사람들에게는 그들의 성씨 앞에 Mr, Ms를 붙여 호칭합니다.
  • 기본적으로 소송에는 많은 서류가 필요합니다. 혹시 법원이 요청한 서류가 있는지 확인하시고, 필요하다면 추가 사본도 챙겨가세요.

*뉴질랜드의 법정은 일반적으로 영어로 통용됩니다. 영어가 모국어가 아니라서 법정에서의 진술을 도와줄 통역사가 필요하다고 생각되면 ‘통역 요청’ 양식을 작성해야 합니다. 출석 전에 해당 법원에 양식을 제출하세요.

 

자기변호
법원에 도착하면 보안을 통과해야 합니다. 이 후 어디로 가야할지 잘 모르는 경우 법원의 직원에게 물어보세요. 법정에서 선서나 확언을 해야 할 수도 있는데, 이것은 진실을 말하겠다는 당신의 서약입니다. 절차가 끝난 후 직원이 다음 단계를 도와줄 수는 있지만, 법적 조언은 해줄 수 없습니다. 법률 자문은 변호사나 CAB에 문의해야 하세요.
반드시 변호인을 선임해야 하는 것은 아니며, 자기 변호를 할 수 있습니다. 하지만 법정에서 자신을 적절히 변호하려면 오랜 기간에 걸친 많은 조사, 준비, 관리가 필요합니다. 판결이 나기까지 대부분 몇 달, 길게는 몇 년이 걸리기도 합니다. 승소하여 보상받을 자격이 있다고 하더라도 자기 변호에 소요된 시간과 돈은 보장해주지 않습니다.
