배심원
배심원은 12명의 배심원으로 구성되지만 보통 한 번에 12명 이상이 법원에 의해 소환됩니다. 이는 지역 사회 내 다양한 범위를 대표하는 배심원들을 충분히 확보하기 위해 그렇습니다. 그렇다고 모든 사람이 배심원단 자리로 소집되는 것은 아니며, 선택되지 않은 일부는 자유롭게 나가서 집으로 돌아가도 됩니다. 경우에 따라 둘 이상의 재판에 참여해야 할 수 있으며, 추후에 다시 불려가거나 근처에 머무르라는 요구를 받기도 합니다.
12 명의 배심원 중 한 명으로 배심원 상자에 앉기로 선택한 경우 판사가 선서를 하도록 시킵니다. ‘선서’는 당신이 판결을 내릴 때 정직하고, 편견없이, 공정하게 할 것을 맹세/확언하는 것입니다. 그 다음에 법정 절차가 진행됩니다. 재판에서 주어진 모든 증거를 듣고 동료 배심원들과 함께 피고인의 유죄 여부를 결정합니다.
친구나 가족에게 재판에 대해 말하지 말고, 혼자 힘으로 직접 조사하려고 하지 마세요. 제시된 사실을 경청하고 이에 근거하여 판단해야 합니다. 재판이 마무리되면 법원 직원으로부터 어떻게 선고되었는지 알아볼 수 있고, 필요한 경우 상담을 진행할 수 있습니다.

참석할 수 없다면
배심원으로 참여하라는 법원에 소환장을 받았지만 지정된 날짜에 참석할 수 없는 경우, 불참 사유와 함께 자신의 의사나 고용주로부터 받은 서신을 가지고 법원에 알려야 합니다. 그럼 법원은 다른 날짜로 조정해주기도 합니다. 배심원 서비스는 시민으로서의 의무의 일부이며, 정당한 이유를 제시하지 않고 지정된 날짜에 법원에 참석하지 않으면 1,000NZD의 벌금이 부과될 수 있습니다.
