オークランド市議会は、ニューリンの家が、所有者のスクデフ・シンが主張するような通常の家としてではなく、違法な下宿として使用されていることを確認しました。この家はヒネコウ通りにあり、その価値は110万ドルで、緊急住宅や短期滞在用の住宅として使われている。

住宅の違法使用を理由に、議会は2015年12月に初めて修正通知を出しました。2022年3月、調査の結果、5人のテナントが本館の別々の寝室に住み、2人が改造されたガレージに住んでいることが明らかになりました。議会は、火災安全要件がより厳しいこの用途を許可する許可証がないことを発見した。

さらに、市議会は、安全でないガス設備や火災による被害の兆候を理由に、ガレージの建設に関する危険で不衛生な建築に関する通知を出しました。ガレージユニットは汚れており、窓が壊れていて、基本的な生活水準を満たしていないと見なされていました。

2022年11月までに問題が解決されなかったため、議会は侵害通知を出しました。シン氏は必要な作業が完了したと主張し、通知を取り下げるよう求めた。しかし、評議会は同意しませんでした。その後、シン氏はこの問題をビジネス・イノベーション・雇用省に持ち込み、審査を求めた。

シン氏は、この物件は緊急住宅用であり、5人しか住んでいないので、単一世帯と見なすべきだと主張した。そのガレージは安全で、ガス供給も遮断されていたと彼は言った。議会は、居住者の数ではそれが寄宿舎であるかどうかは分からないと反論した。

同省の顧問であるペタ・ハードは、本館は単世帯としてではなく「寝室」として使われているとの判決を下した。しかし彼女は、このガレージは一人家族を収容できるので、「戸建住宅」として認められる可能性があると指摘した。

Hirdは、Singhは建築法に違反して、用途の変更について議会に通知していなかったと述べています。それでも彼女は、彼に追加の報告を提出するよう求める議会の要求は法的強制力がないことに気付きました。

ガレージは危険だという議会の評価は支持されたが、不衛生だという主張は支持されなかった。その結果、Hirdは、本館と車庫の衛生状態に関する修正通知を撤回するよう勧告しました。

シンはヒネコウ通りに3つの物件を所有しており、そのうちもう1つは緊急住宅として使用されていました。彼の建築コンサルタントであるアラン・ライトは、決定の一部には同意しなかったが、上訴の可能性があることを認めた。彼は、建築法により、居住者が6人未満の一部の寄宿舎を戸建住宅と見なすことが認められていると指摘しました。

議会のコンプライアンス・マネージャーであるエイドリアン・ウィルソン氏は、必要な通知の再発行を検討するため、決定を検討中であると述べました。
