직장 불만 해결
만약 고용주와 의견이 일치하지 않는다면, 이 문제를 해결하는 방법은 여러 가지가 있습니다. 가장 유리한 방법은 일반적으로 근로 계약과 최소의 권리를 기준으로 하여 두 명, 또는 그 이상의 직원들과 함께 의견을 모아 조율해 나가는 방법입니니다. 고용주와 직장 문제를 해결할 수 없거나 부당 대우를 받고 있다고 생각이 든다면, 상위 정부 기관에 문의해보세요.
차별, 괴롭힘, 부당한 경고, 잘못된 보건/안전 관행, 휴일, 계약 또는 임금 분쟁, 기타 최소 권리 침해 및 근로 계약 위반을 이유로 고용주에 대한 불만을 제기할 수 있습니다. 근무 중에 징계를 받는 경우 서면으로 경고가 있었는지, 경고를 받은 이유를 충분히 이해했는지 확인하세요.

 

첫번째 단계
불만을 제기하려는 상사에게 불만 이유, 이를 해결하기 위해 어떤 조치를 취했으면 하는지를 설명하는 이메일이나 서신을 직접 보내는 것입니다. 상사가 충분히 대응하고 불만을 제기하는 이유를 이해할 수 있도록 많은 정보를 제공하세요. 말로하면 기록을 남기기 어렵고, 만약 일이 원만하게 해결이 안되면 고소장에 기재된 모든 내용을 적어야 하기 때문에 되도록 서면으로 공식적인 불만을 제기하는 것이 중요합니다.
고용주와 미팅을 주선하는 것도 좋습니다. 만약 고용주가 제3자의 관점에서 상황을 이해하는 데 도움이 될 것 같거나 본인이 필요한 경우 노조 대표나 다른 업계 전문가를 미팅에 데려오세요.

대안

노동 조사관에게 연락할 수도 있습니다. 이들은 신청자가 직장에서 법적으로 받을 수 있는 권리를 조사하고 불공정하거나 위험한 관행에 대한 보고서를 제공할 수 있는 사람입니다. 사건 발생 후 90일 이내에 불만 사항을 등록하면 ERA(Employment Relations Authority, 고용 관계 기관)에 문의할 수 있습니다. ERA는 고소에 대한 조언을 제공하는 정부 서비스이며, 사안이 충분히 심각하다고 판단될 경우 노동법원에서 법원 사건으로 다루어질 수 있도록 합니다. ERA에서는 먼저 조정을 제시할 가능성이 높으므로 이는 마지막 수단으로 사용해야 합니다.
법률 자문이 필요한 경우 커뮤니티 법률 센터에서 무료 자문을 제공하고 노동 변호사와 상담을 잡아볼 수 있습니다. 만약 변호사가 해당 사안이 법정까지 가서 해결해볼 수 있다는 판단을 하면 이 사건을 수임하겠다고 제안할 수도 있습니다.
